1. Terms and definitions
1.1. Operator — Individual Entrepreneur Paranichev Dmitry Alexandrovich, TIN 860319715652 (hereinafter — the «Operator»), operating in accordance with the legislation of the Russian Federation.
1.2. Password — a unique sequence of alphanumeric characters generated during registration that provides access to the Palert service.
1.3. User — an individual or legal entity seeking or having obtained access to the Palert service.
1.4. Registration — the process of entering the data required to create an account and gain access to Palert's features.
1.5. Service — the Palert web application and its browser extensions, designed to track and monitor product prices on marketplaces.
2. General provisions
2.1. This Agreement governs the rights and obligations of the Operator and the User when using the Palert service. Use of the service begins at the moment the User accepts the terms of the Agreement.
2.1.1. The Operator's details and contacts are listed in Section 8 of this Agreement.
2.2. The Palert services are provided to help users track and monitor product prices across various marketplaces.
2.3. By continuing to use the Palert system or by completing the registration process, the User agrees to the terms of this Agreement in full.
2.4. The Operator has the right to make changes to this Agreement. The current version is published on the official Palert website. Material changes may be accompanied by a notice to the User in the service interface or by another available means.
2.5. If the User does not agree with the terms of the Agreement or the requirements for using the service, they have no right to use the Palert service.
3. Registration and use of the services
3.1. User registration is carried out by providing accurate data required to create an account in the Palert system.
3.2. The User undertakes to provide up-to-date information. If false data is provided, the Operator has the right to block the User's account.
3.3. By using the Palert service, the User confirms that they have read the personal data processing terms set out in Section 5 of this Agreement and in the Palert Privacy Policy.
3.4. The User is responsible for keeping their password and other data used to access the Palert service confidential.
3.5. In the event of unauthorized access or a security breach of the account, the User must immediately notify the Operator. The Operator is not liable for the consequences of a User's failure to fulfill this obligation.
4. Rights and obligations of the parties
4.1. The User is obliged to:
- 4.1.1. Provide, by their own means and at their own expense, access to the «Internet» information and telecommunications network, as well as the setup and protection of their equipment against unauthorized use.
- 4.1.2. Keep the User's password and other means of identification confidential.
- 4.1.3. Accept full responsibility for all requests and actions made through their account after registration.
- 4.1.4. Comply with the terms of this Agreement.
4.2. The User has the right to:
- 4.2.1. Use the features of the Palert services in accordance with the terms of this Agreement.
- 4.2.2. Send inquiries to the Operator regarding the operation of the system and technical issues in its functioning.
- 4.2.3. Give consent to the transfer of their data to other services or systems related to the use of Palert services.
4.3. The User is not entitled to:
- 4.3.1. Post content that violates the legislation of the Russian Federation or intellectual property rights, contains malware, violates the rights of others, or promotes hatred and discrimination.
- 4.3.2. Violate the rights of third parties, including minors, causing them harm in any way.
- 4.3.3. Upload, distribute, or transmit unauthorized advertising, spam, or content unrelated to the functionality of the Palert system.
- 4.3.4. Take actions aimed at disrupting the operation or security of the system, or attempt unauthorized access to other users' data.
4.4. The Operator is obliged to:
- 4.4.1. Ensure the operation of the Palert services in accordance with this Agreement.
- 4.4.2. Ensure the security of Users' data, the safekeeping and non-disclosure of information provided by the User.
- 4.4.3. In the event of technical issues, take measures to restore service operation as quickly as possible.
- 4.4.4. Ensure regular system updates to improve its functionality and security.
4.5. The Operator has the right to:
- 4.5.1. Reject a User's registration in the event of false information or a violation of the terms of the Agreement.
- 4.5.2. Suspend the provision of services in cases where the User violates the terms of the Agreement, in the event of unforeseen technical failures or circumstances related to system security, and upon detection of suspicious activity by the User.
- 4.5.3. Send the User informational notices related to the operation of the Palert system, technical updates, and changes in functionality.
- 4.5.4. Engage third parties to ensure system functionality and to perform technical work.
- 4.5.5. Carry out maintenance work, temporarily suspending system operation in order to improve the quality of services provided.
4.6. The Operator is not liable for:
- 4.6.1. Accidents, failures, or interruptions in the operation of the Palert services caused by technical issues with equipment, disruptions in communication systems, or networks operated by third parties.
- 4.6.2. Damage incurred by the User as a result of «viruses» and other malware on the User's equipment; the User's violation of the terms of the Agreement; the unlawful actions of third parties, including unauthorized access to the User's account.
- 4.6.3. The quality and timeliness of services provided by third-party organizations and the accuracy of information provided by third parties.
4.7. Other provisions: The User and the Operator are not liable for non-fulfillment of obligations in the event of force majeure, such as natural disasters, military actions, terrorist acts, power outages, or other circumstances beyond the parties' control.
5. Consent to the processing of personal data
5.1. By this, in accordance with Federal Law No. 152-FZ «On Personal Data» dated July 27, 2006, the User freely, by their own will and in their own interest, expresses their consent to the processing of their personal data by the Operator.
5.2. List of personal data for which consent to processing is given:
- Email address;
- Identifiers from third-party services (e.g., Telegram ID, Google sub, Yandex ID);
- IP address;
- User-agent;
- Cookie / session id;
- First name and last name (when provided by the User);
- Phone number (when provided by the User);
- Region information (when provided by the User);
- Information about products added to the watchlist;
- Service usage data (activity log, settings, actions);
- Other data provided by the User in the course of using the service.
5.3. Purposes of processing personal data:
- Registration and authentication of the User;
- Provision of the service;
- Notifications and messages related to use of the service;
- Ensuring security and preventing abuse;
- Analytics and improvement of the service (in anonymized form).
5.4. The Operator may perform the following actions with personal data: collection, recording, systematization, accumulation, storage, clarification (updating, modification), use, transfer (when necessary), anonymization, deletion.
5.5. Personal data may be transferred to third parties that process personal data on the Operator's behalf (hosting providers, notification delivery services, analytics, authentication), strictly to the extent necessary to achieve the stated processing purposes, provided that such parties comply with the requirements of Russian personal data legislation.
5.6. Data processing may be carried out both with and without the use of automated systems.
5.7. The period of personal data processing — for the duration of the account's existence and after its deletion, for periods established by the legislation of the Russian Federation and necessary to protect the rights and legitimate interests of the Operator.
5.8. Consent may be withdrawn at any time by sending a notice via the Operator's contact details listed in Section 8 of this Agreement, and/or through the user account (if the feature is available). The response period is up to 30 calendar days.
5.9. In the event of withdrawal of consent to the processing of personal data, the Operator has the right to continue processing the data without the User's consent in cases provided for by the legislation of the Russian Federation.
6. Liability
6.1. The Operator is not liable for failures, interruptions, or errors in the operation of the Palert system caused by external factors, such as issues with equipment or communication networks under the control of third parties.
6.2. The User bears full responsibility for their actions in the Palert system, including providing false information, violating the terms of this Agreement, and failing to maintain the confidentiality of their login credentials.
6.3. The Operator is not liable for any possible damage incurred by the User as a result of unlawful actions by third parties, including unauthorized access to the User's account, unless such actions became possible through the Operator's fault.
6.4. The Operator is not liable for the quality or timeliness of services provided by third parties in connection with the use of the Palert system, nor for the accuracy of information provided by such parties.
7. Miscellaneous
7.1. This Agreement is governed by the legislation of the Russian Federation.
7.2. All disputes and disagreements arising in connection with this Agreement are resolved in accordance with the legislation of the Russian Federation.
